Senior Military, Intelligence, and Government
Officials Question 9/11 Commission Report

Many respected senior members of the U.S. military, intelligence services, and government have expressed significant criticism of the 9/11 Commission Report. Some even allege government complicity in the terrible acts of 9/11. Below are the highly revealing statements on this vital topic of over 50 prominent public servants with links for verification and further investigation.

The collective voices of these respected senior officials give credibility to the claim that the 9/11 Commission Report is tragically flawed. These dedicated individuals from both political parties cannot be simply dismissed as irresponsible believers in some 9/11 conspiracy theory. Their sincere concern, backed by decades of service to their country, demonstrate that criticism of the 9/11 Commission Report is not only reasonable and responsible, it is in fact a patriotic duty.

FEDERAL GOVERNMENT OFFICIALS

Congressman Curt Weldon, "What's the Sept. 11 commission got to hide?"

Rep. Curt Weldon

Rep. Curt Weldon – Ten-term Republican Congressman from Pennsylvania. House Armed Services Committee Vice Chairman. Homeland Security Committee Vice Chairman.

  • U.S. House of Representatives Speech 10/19/05:
"Intelligence officers ... identified [lead 9/11 hijacker] Mohammed Atta and three terrorists a year before 9/11, tried to transfer that information to the FBI, were denied, and the FBI Director has now said ... the FBI could have used it to perhaps prevent the hijackings. The 9/11 Commission totally ignored this entire story.

I am a strong supporter of our military. I am a strong supporter of President Bush. I say all of that, Mr. Speaker, because ... there is something desperately wrong here. I have met with at least 10 people who fully corroborate what [intelligence officer] Tony Shaffer says. This is not [about] Republicans or Democrats. It is about what is fundamental to this country."

  • Fox News 8/28/05: "'There's something very sinister going on here that really troubles me,' Weldon told Fox News on Thursday, blasting the 9/11 commission for not taking the claims more seriously. He said some panel members were trying to smear Shaffer and Able Danger. 'What's the 9/11 commission got to hide?'"

U.S. Senator from Georgia 1996-2002. Administrator of U.S. Veterans Administration 1977-1981. Awarded Silver Star and Bronze Star for U.S. Army bravery in Viet Nam. Triple amputee from war injuries.

  • Boston Globe Article 11/13/03: "If this decision stands [to limit 9/11 Commission access to White House documents], I, as a member of the commission, cannot look any American in the eye, especially family members of victims, and say the commission had full access. This investigation is now compromised."

Louis Freeh, "No wonder the 9/11 families were outraged by these revelations and called for a "new" commission to investigate."

Louis Freeh

Louis Freeh – Director of FBI, 1993-2001. Former U.S. District Court Judge for Southern District of New York, appointed by President George H.W. Bush. Former Deputy United States Attorney in New York. Former FBI agent. Former officer in United States Army.

  • Wall Street Journal 11/17/05: "Even the most junior investigator would immediately know that the name and photo ID of [lead 9/11 hijacker Mohammed] Atta in 2000 is precisely the kind of tactical intelligence the FBI has many times employed to prevent attacks and arrest terrorists. Yet the 9/11 Commission inexplicably concluded that it 'was not historically significant.' This astounding conclusion—in combination with the failure to investigate Able Danger and incorporate it into its findings—raises serious challenges to the commission's credibility and, if the facts prove out, might just render the commission historically insignificant itself. No wonder the 9/11 families were outraged by these revelations and called for a 'new' commission."

Fred Burks

Fred Burks – Former State Department Interpreter for Presidents George W. Bush and Bill Clinton, Vice Presidents Dick Cheney and Al Gore, Secretaries of State Colin Powell and Madeleine Albright. 18-year State Department career.

  • Essay: "How is it possible that our military's highly touted missile detections systems could not locate Flight 77 in the 42 minutes it was known to be lost before it crashed into the heart of the defense system of the U.S.?

An even bigger question is why isn't our media asking these questions? Why isn't our military spending many millions of dollars to find out why military defense systems failed on 9/11? Why is it that the 9/11 Commission budget was far less than the budget allotted to the Challenger Disaster or even the Monica Lewinsky affair?" http://www.WantToKnow.info/911...

Colonel Robert Bowman, “A lot of these pieces of information, taken together, prove that the official story, the official conspiracy theory of 9/11 is a bunch of hogwash. It’s impossible."

Col. Robert Bowman

Col. Robert Bowman, PhD, U.S. Air Force (ret) – Director of Advanced Space Programs Development under Presidents Ford and Carter. Air Force fighter pilot, over 100 combat missions. PhD in Aeronautics, Nuclear Engineering.

  • Video: "A lot of these pieces of information, taken together, prove that the official story, the official conspiracy theory of 9/11 is a bunch of hogwash. It’s impossible. … There’s a second group of facts having to do with the cover up. Taken together these things prove that high levels of our government don’t want us to know what happened and who’s responsible. Who gained from 9/11? Who covered up crucial information? And who put out the patently false stories about 9/11 in the first place? I think the case is pretty clear that it’s highly placed individuals in the administration with all roads passing through Dick Cheney. I think the very kindest thing that we can say about George W. Bush and all the people in the U.S. Government that have been involved in this massive cover-up ... is that they were aware of impending attacks and let them happen. However even that is high treason and conspiracy to commit murder." http://video.go...

George Nelson, "With all the evidence readily available at the Pentagon crash site, any unbiased rational investigator could only conclude that a Boeing 757 did not fly into the Pentagon as alleged."

Col. George Nelson

Col. George Nelson, U.S. Air Force (ret) – Former U.S. Air Force aircraft accident investigator and airplane parts authority. 34-year Air Force career.

  • Essay: "The government alleges that four wide-body airliners crashed on the morning of September 11 2001, resulting in the deaths of more than 3,000 human beings, yet not one piece of hard aircraft evidence has been produced in an attempt to positively identify any of the four aircraft. On the contrary, it seems only that all potential evidence was deliberately kept hidden.

With all the evidence readily available at the Pentagon crash site, any unbiased rational investigator could only conclude that a Boeing 757 did not fly into the Pentagon. Similarly, with all the evidence available at the Pennsylvania crash site, it was most doubtful that a passenger airliner caused the obvious hole in the ground and certainly not the Boeing 757 as alleged.

As painful and heartbreaking as was the loss of innocent lives and the lingering health problems of thousands more, a most troublesome and nightmarish probability remains that so many Americans appear to be involved in the most heinous conspiracy in our country's history." http://www.physics911.net/georgenelson....

Colonel Ronald Ray, "I'm astounded that the conspiracy theory advanced by the administration could in fact be true and the evidence does not seem to suggest that's accurate."

Col. Ronald D. Ray

Col. Ronald D. Ray, U.S. Marine Corps (ret) – Deputy Assistant Secretary of Defense during Reagan Administration. Highly decorated Vietnam veteran (two Silver Stars, a Bronze Star and a Purple Heart). Appointed by President George H.W. Bush to serve on American Battle Monuments Commission. From 1990 to 1994, served as Military Historian and Deputy Director of Field Operations for U.S. Marine Corps Historical Center, Washington, D.C.

  • Article: "The former Deputy Assistant Secretary of Defense under the Reagan Administration and a highly decorated Vietnam veteran and Colonel has gone on the record to voice his doubts about the official story of 9/11 - calling it ‘the dog that doesn't hunt.' Ray questioned the feasibility of having a budget of half a trillion dollars a year, yet not even being able to defend the Pentagon. • Testimony before the House Armed Services Committee 2/15/06 (page 18) - “After contact by two separate members of the Able Danger team … the 9/11 [Commission] staff refused to perform any in-depth review of investigation of the issues that were identified to them. … It was their job to do a thorough investigation of these claims – to not simply dismiss them based on what many now believe was a “preconceived” conclusion to the 9/11 story they wished to tell. … I consider this a failure of the 9/11 staff ... as is evidenced by their recent, groundless conclusion that Able Danger’s findings were “urban legend.” http://www.abledan...

'For a guy to just jump into the cockpit and fly like an ace is impossible,' said Wittenberg, recalling that when he made the jump from Boeing 727s to the highly sophisticated computerized characteristics of the 737s through 767s, it took him considerable time to feel comfortable flying." http://www.arcticbeacon.com....

Now there are a whole bunch of unanswered questions. And the reason they’re unanswered is because this administration will not answer the questions. This is the bottom line for me; just as Hitler in 1933 cynically exploited the burning of the parliament building, the Reichstag, this is exactly what our President did in exploiting 9/11. The cynical way in which he played on our trauma, used it to justify attacking, making a war of aggression on a country that he knew had nothing to do with 9/11. That suffices for me. That’s certainly an impeachable offense." http://video.google...

Letter to Congress on 9/11 Commission Report

"We the undersigned wish to bring to the attention of the Congress and the people of the United States what we believe are serious shortcomings in the [9/11 Commission] report and its recommendations.

Omission is one of the major flaws in the Commission’s report. We are aware of significant issues and cases that were duly reported to the commission by those of us with direct knowledge, but somehow escaped attention.

The omission of such serious and applicable issues and information by itself renders the report flawed, and casts doubt on the validity of many of its recommendations."

9/11 is unquestionably the most important event in American history since December 7, 1941, when Japanese forces attacked Pearl Harbor. The magnitude of its impact on America and the world cannot be overstated. The terrible acts of 9/11 and the events leading up to them deserve a thorough and unimpeachable investigation to learn the facts. And if some rogue elements within the U.S. government were complicit in the terrorist attacks on the World Trade Center and the Pentagon on 9/11, as several of these individuals allege, it is critical that these elements be exposed and removed from power.

Note of acknowledgement: Most of this excellent data was compiled by Alan Miller. For the latest version of this chart on his website: http://www.patriotsquestion911.com. Please note that most of the individuals listed above are not affiliated with this website.

A PERSONAL NOTE ABOUT THIS WEBPAGE FROM ALAN MILLER

I believed the official explanation of 9/11 for four and one-half years. I remember, during that time, becoming angry at news stories about people who challenged that explanation. However, in the Spring of 2006, I saw the documentary, Loose Change, on the Internet. Although not entirely objective, it raised many serious and disturbing questions about the events of 9/11 that I had previously simply accepted without much critical thought.

And so I began a several month period of researching the events of 9/11. I found a great deal of material challenging the 9/11 Commission Report on web sites like 911truth.org, physics911.net, Scholars for 9/11 Truth and many others. I attended a lecture by Prof. David Ray Griffin. I learned much about what has become known as the 9/11 Truth Movement.

Much of the information and limited media coverage of the 9/11 Truth Movement focuses on college professors like David Ray Griffin, Steven Jones, James Fetzer, Kee Dewdney, and others. In August of 2006, I began searching for statements about 9/11 by members of the intelligence services, military and government. Because of their experience in these areas, I felt their opinions about 9/11 would be an additional valuable source of information. I was surprised by the amount of criticism of 9/11 from this group that I found scattered around the Internet. I had learned of virtually none of this criticism through newspapers, television, or radio news sources.

I don't know what really happened on 9/11. I greatly value these individuals' statements because most have spent large portions of their careers studying espionage, terrorism, and military operations throughout the world and personally planned and carried out United States' military and intelligence activities. They're experienced professionals, whom I trust.

My objective, at this point, is to have our government launch a new, extremely thorough and impartial re-examination of the terrible acts of 9/11 and the events leading up to them. In my opinion, and in the opinion of the above listed experienced individuals, the current 9/11 Commission Report is seriously inadequate in explaining what really happened.

For the sake of those who died on 9/11, their families, the American people, and for the sake of peace in the world, please continue to seek the truth about 9/11. Demand a thorough and impartial reinvestigation of 9/11.

If you are or know of an active or former senior member of the military, intelligence services, or government, who has publicly expressed concerns about the 9/11 Commission Report, and would like your comment to be added to this list, please email your information to me.

Sincerely,

Alan Miller

A massive failure of U.S. diplomacy

Understatement of the century...

News Analysis: A massive failure of U.S. diplomacy

By David E. Sanger The New York Times

Published: October 9, 2006

WASHINGTON For a tiny, starving, friendless nation of 23 million people, the small nuclear device that exploded Monday, apparently successfully, in the mountains above the town of Kilju in North Korea represented a last bid for survival and respect.
For Washington and its allies, it represented a massive failure of atomic diplomacy.
It was more than just another nation joining the nuclear club, more than just an effort by North Korea to follow the path of Pakistan, another country that overcame huge hurdles and damaging sanctions. Pyongyang's development of a nuclear weapon portends the dawning of a very different era, as President George W. Bush seemed to acknowledge Monday in brief, somewhat cryptic comments.
What worries Bush about North Korea is not where its warheads are aimed, but in whose hands they may end up. That is why he declared that the United States would regard as a "grave threat" any transfer of atomic knowledge from the North to other nations or terror groups.
To the president's critics, the North Korean test was the inevitable outcome of a Bush administration approach that never gave as much priority to nonproliferation as it did to overthrowing Saddam Hussein.
It was in the months before the American invasion of Iraq in early 2003 that North Korea made its nuclear breakout - when it kicked out inspectors and very publicly began its drive to turn its stockpiles of spent fuel rods into weapons. Bush and his administration chose then to do nothing. The North Korean test raises the question of whether it is too late for the president to make good on his promise that "the world's worst dictators don't get the world's most dangerous weapons."
Former Senator Sam Nunn, the Georgia Democrat who has spent his post-congressional career trying to halt a new age of proliferation, said in an interview Monday: "What it tells you is that we started at the wrong end of the Axis of Evil. We started with the least dangerous of the countries, Iraq, and we knew it at the time. And now we have to deal with that."
Bush and his aides dispute that view, arguing that Iraq was the more urgent threat in 2003, given its role at the center of a volatile Middle East.
But foreign policy, as Nunn said, is "all about priorities," and until now the closest Bush came to drawing what in the Cold War was called a "red line" for the North came in May 2003, when he declared that the United States and South Korea would "not tolerate nuclear weapons in North Korea."
The Central Intelligence Agency's estimates in the years since have been that the United States has been tolerating exactly that - a small arsenal of nuclear fuel sufficient to produce six or more weapons.
Monday morning, hours after the North's test, Bush did not repeat that threat. Instead, he drew a new "red line" - one that appeared to tacitly acknowledge the North's possession of weapons. North Korea, he said, "remains one of the world's leading proliferators of missile technology, including transfers to Iran and Syria."
He went on to warn that "the transfer of nuclear weapons or material by North Korea to states or nonstate entities would be considered a grave threat to the United States, and we would hold North Korea fully accountable of the consequences of such action."
To critics of Bush's policy, this was a moving of the goalposts, a recognition that U.S. policy - reaching back over at least four presidents - has failed to control the makings of the bomb.
"Think about the consequences of having declared something 'intolerable,' and last week 'unacceptable,' and then having North Korea defy the world's sole superpower and the Chinese and the Japanese," said Graham Allison, a Harvard professor who has studied nuclear showdowns from the Cuban missile crisis on. "What does that communicate to Iran and then the rest of the world? Is it possible to communicate to Kim credibly that if he sells a bomb to Osama bin Laden, that's it?"
Allison was touching on the central dilemma facing Washington as it tries to extract itself from the morass of Iraq. Whether accurately or not, other countries around the world perceive Washington as tied down, unable or unwilling to challenge them while 140,000 troops are tied up in a bloody war.
Kim may have calculated, many experts said, that at this point there was little more that the Bush administration could do to him. The United States has imposed sanctions on his country since the end of the Korean War. The new crackdown on the banks through which the North conducts many of its illicit activities - counterfeiting, missile sales, trade in small arms - are being choked off, a step the North Korean leaders presumably see as part of a strategy of bringing down the regime.
"He's probably betting that there is nothing we can do to bring the Chinese and the Russians together on cutting off his oil, and he may be right," a senior American official said after the North threatened the nuclear test. "And he may think that his negotiating leverage will be a lot greater if he has proven that he's got the bomb."
If so, Kim may have calculated that this is his moment, when Bush, in the last two years of his presidency, cannot afford another military confrontation. It may be years, or decades, before historians will know whether Iraq played into Kim Jong Il's calculations about when to conduct a nuclear test. But clearly, managing simultaneous crises around the world is straining the system in Washington, and posing the United States with more direct challenges than it can handle at one moment.
The question for Bush now is the one he faced when he came to office: Can he best contain one of the world's most unpredictable regimes by trying to further isolate it, or by trying to draw it out of its paranoid shell?

An Enemy and War Born from Ignorance

An Enemy and War Born from Ignorance
by James Carroll
Boston Globe

I was a senior in high school, attending the American school in Wiesbaden, West Germany, where the US Air Force had its headquarters and where my father was stationed.

It was 1959, and the Cold War tension was focused on Berlin. Because that divided city was well inside the Soviet sector of East Germany, and because it served as an escape hatch for citizens behind the Iron Curtain, Nikita Khrushchev was pressing the French, British, and American forces to get out.
President Eisenhower was holding firm, insisting on a strict reading of the four-party treaty that had divided the city. The Soviets were looking for an excuse to call off the treaty, and that's where I came in.

My friends and I were fans of the Formula 1 automobile racing circuit, and a Grand Prix that year was to take place in Berlin. The flashpoint city was effectively off-limits to the like of us, but we went anyway.

A US Army train crossed through the Communist zone every day, carrying GIs and their dependents through East Germany to the island city. The Soviets hated this incursion, but the treaty allowed it. The treaty also underwrote strict regulations for the train, however, and American passengers were instructed in the rules by the military policemen who served as conductors.

When the train approached the East-West border, the military police went through the compartments, closing the window shades and explaining that lifting the shades was strictly forbidden. They gave absolute emphasis to the prohibition of any photography at the border. I have recounted this memory elsewhere, but it comes to mind in the context of recent news.

When the train hissed to a stop, we boy-adventurers in our darkened compartment could hear the barked orders outside, the familiar cadence of German, but also the odd sounds of another language we took to be Russian. It was like hearing the dialogue of a movie without being able to see the screen, and we simply couldn't resist. Up went the window shade, but only by an inch.
``Tanks!" my buddy whispered. ``Red stars!"

Soviet troops were lined up to face-off with GIs, all with weapons ready. I was the one to put the lens of my camera at the small opening. I pushed the button. Before I knew it, the door behind us slammed open.

I was roughly jerked away from the window, and in a flash the back of the camera was open, the film unspooled and strewn around the compartment. It was the American MP, and his rough reaction was deliberate, a firm enforcement of border regulations to impress the Soviet and East German officers who were right behind him. They wanted at us, but the MP held them off.

After the East German and Soviet officers backed out of the compartment, the MP checked our identification and wrote us up. He was calmer now, but I sensed his contempt. As he handed my ID back , he looked at me hard and snarled, ``Some damn fool like you is going to start World War III."
That rebuke lives in my memory as a measure of my own immaturity -- a drastic failure to match my action to its potential consequence. I hear the MP's words now, however, as a judgment on contemporary American leadership.

World War III never came in the contest with Moscow, and though the image is sometimes evoked today to describe the war on terrorism, this is not World War III either. But the callow impulsiveness that risks catastrophe out of ignorance and self-centeredness does apply. That MP on the train was pronouncing a prophecy that has come true.

The National Intelligence Estimate that was partially declassified last week shows the government's own assessment of what has followed from President Bush's decision to go to war in Iraq -- a decision he made in stark defiance of warnings of history.

``Anti-US and anti globalization sentiment is on the rise and fueling other radical ideologies," the estimate said. ``This could prompt some leftist, nationalist, or separatist groups to adopt terrorist methods to attack US interests. The radicalization process is occurring more quickly, more anonymously in the Internet age."

The estimate itself thus points to a conclusion:
Bush created a cohesive enemy where it did not really exist before. So-called jihadists have been rallied, strengthened, and made lethal by Iraq. They will haunt the world for years, in a global war unlike anything ever seen before. All of it unnecessary. Foolishness worthy of a stupid child.

That summarizes the big picture quite well.

James Carroll's column appears regularly in the Globe.

9/11 Want to Know Video- Jersey Girls

Watch The Video

http://www.WantToKnow.info/911video

Dear friends,

Possibly the best, and certainly the most professionally produced 9/11 video documentary is the moving story 9/11: Press For Truth. This highly engaging video traces the passionate journey of a small group of grieving families who waged a tenacious battle against those who sought to bury the truth of the events surrounding that fateful day. In 9/11: Press For Truth, six courageous 9/11 family members, including three of the famous "Jersey Girls," tell for the first time the powerful story of how they took on the greatest powers in Washington—and won! Their tireless efforts eventually led to an investigation by the 9/11 Commission. Yet learn how the final report then tragically failed to answer their most probing questions.

In this very well documented 9/11 video, these frustrated family members who lost loved ones on 9/11 take us on a harrowing quest as their initial explorations lead to ever deeper, more puzzling questions. What actions were taken by top government officials who received dozens of specific warnings before the attack? Was Osama Bin Laden and his top al Qaeda leadership allowed to escape from Afghanistan? What has been the reason for the deliberate obscuring of evidence for complicity of elements within government? And perhaps the most important one of all: Why, five years later, are so many of the families’ questions still unanswered? Watch this landmark 9/11 video free at one of the links below.

US Spy Agency CIA Paid Pakistan for al-Qaeda Suspects

US Spy Agency CIA Paid Pakistan for al-Qaeda Suspects: Musharraf ...(and that's not all)
by David Espo

Who's side is Pakistan on? Not Ours, inspite of Pakastani ISI wining and dining the Bush regime the days before and during the attacks.

The US Central Intelligence Agency paid Pakistan millions of dollars for handing over more than 350 suspected al-Qaeda terrorists to the United States, Pakistani President Pervez Musharraf has reportedly said.

The US Central Intelligence Agency paid Pakistan millions of dollars for handing over more than 350 suspected al-Qaeda terrorists to the United States, Pakistani President Pervez Musharraf, seen here on 22 September 2006, has reportedly said.(AFP/File/Mandel Ngan)

The assertions come in the military ruler's upcoming memoir "In the Line of Fire," serialized in The Times newspaper.

Musharraf does not reveal how much Pakistan was paid for the 369 Al-Qaeda suspects he ordered should be handed over to the United States, the newspaper said, noting, however, that such payments are banned by the US government.

The newspaper does not, however, print or quote the excerpts which make the allegations.
In response a US Department of Justice official was quoted as saying: "We didn't know about this. It should not happen. These bounty payments are for private individuals who help to trace terrorists on the FBI's most wanted list, not foreign governments."

The Pakistani's leader's claims come after he said last week that former deputy secretary of state Richard Armitage had threatened to bomb Pakistan if it did not back the United States in the so-called "war on terror" in the aftermath of the September 11, 2001 attacks, described by Musharraf as "what has to be the most undiplomatic statement ever made."

"Our relationships with international leaders is not something we are prepared to talk about," a CIA official told The Times. (uh-huh)

Musharraf also writes that he was so angered by American demands in the wake of the September 11 attacks, which he calls "ludicrous," that he "war-gamed the United States as an adversary."
"There would be a violent and angry reaction if we didn't support the United States," an excerpt from his book reads.

"The question was: if we do not join them, can we confront them and withstand the onslaught? The answer was no."
He said that two days after the attacks, the US Ambassador to Pakistan Wendy Chamberlain brought to him a set of seven demands including "blanket overflight and landing rights" and "use of Pakistan's naval ports, air bases, and strategic locations on borders."

Musharraf said Pakistan gave no "blanket permission" for anything.
The military leader also says that he decided to make the revelations to counter claims that Pakistan had not done enough to combat Al-Qaeda in the war on terror.

Dear America:

Our Call to drive out the Bush regime lays out an indictment of the crimes this regime is committing here and around the world, and shows the fascist direction in which this society is headed. What follows is an online teach-in based on the 7

"YOUR GOVERNMENT" statements that begin our Call. This teach-in below is still under construction, so check back later for more.
(Click on "your government")

YOUR GOVERNMENT, on the basis of outrageous lies, is waging a murderous and utterly illegitimate war in Iraq, with other countries in their sights.

YOUR GOVERNMENT is openly torturing people, and justifying it.

YOUR GOVERNMENT puts people in jail on the merest suspicion, refusing them lawyers, and either holding them indefinitely or deporting them in the dead of night.

YOUR GOVERNMENT is moving each day closer to a theocracy, where a narrow and hateful brand of Christian fundamentalism will rule.

YOUR GOVERNMENT suppresses the science that doesn't fit its religious, political and economic agenda, forcing present and future generations to pay a terrible price.

YOUR GOVERNMENT is moving to deny women here, and all over the world, the right to birth control and abortion.

YOUR GOVERNMENT enforces a culture of greed, bigotry, intolerance and ignorance.

People look at all this and think of Hitler - and they are right to do so. The Bush regime is setting out to radically remake society very quickly, in a fascist way, and for generations to come. We must act now; the future is in the balance.

YOUR GOVERNMENT, on the basis of outrageous lies, is waging a murderous and utterly illegitimate war in Iraq, with other countries in their sights.

Although George W. Bush has said that the US knew Iraq trained al-Qaeda members in making bombs, poisons and deadly gases, and that an alliance with terrorists would allow the Iraqi regime to attack America without leaving any fingerprints, no evidence of this statement has ever been produced. Colin Powell told the UN this alleged training took place in a camp in Northern Iraq.

The area he indicated was later revealed to be outside of Iraq’s control and patrolled by Allied war planes.
Dick Cheney said that it was believed that Saddam Hussein had reconstituted nuclear weapons, while CIA reports up to 2002 showed no evidence for his claim.

Secretary of Defense Donald Rumsfeld said that he knew where Iraq’s weapons of mass destruction were located: “They’re in the area around Tikrit and Baghdad and east, west, south, and north somewhat.” Needless to say, no such weapons have been found east, west, south, and north somewhat.
In George W. Bush's 2003 state of the union address he claimed that Iraq was trying to import uranium from Niger, supposedly to enrich it and advance a nuclear program. The documents that purported that claim was false, and the former head of the CIA has said that information should have never been included in the speech.

The Bush regime has stated that Iraq could deploy its weapons of mass destruction in 45 minutes. This claim was based on a single source which has yet to be named and is contradicted by the statement made by British prime minister, Tony Blair, who said that Iraq had begun to conceal its weapons in May 2002, which meant that they could not have been used within 45 minutes.

The Bush regime wants everyone to believe that Iraq was responsible for the September 11th attacks. The main basis for this claim was a supposed meeting between Mohammed Atta, leader of the 9/11 hijackers, and an Iraqi intelligence officer in Prague. Czech intelligence later concluded that the Iraqi’s meeting was not, in fact, with Atta.

The death toll for Iraq, as it slides into civil war, is a MINIMUM of 39,942, with deaths per day rising from 20 to 36 in the third year of the occupation. American deaths total 2,588 since the beginning of the occupation.

To date, the Iraq war and occupation has cost U.S. taxpayers upwards of $301,678,000,000.
The use of white phosphorus in Iraq was said to have been originally only for illumination at night. When that information was proven false by an Italian documentary featuring the images of dead Iraqis killed by white phosphorus, the US military had to retract its statement, saying it was used as an incendiary weapon against enemy combatants. This weapon ignites on contact with oxygen, burns through the skin and won’t be extinguished unless it is deprived of oxygen. While an international treaty restricts its use, the US is not a signatory to the treaty.

The US military has been accused of unthinkable war crimes: The rape and murder of a fourteen-year old girl in Al-Mahmudiyah, south of Iraq; The massacre of twenty-four unarmed civilians in Haditha; Eleven civilians in Ishaqi forced into the corner of a room, with their hands bound, and shot by US troops. These atrocities and many more are not the result of a few bad apples. Rather, the very nature of this unjust war and the orders given from the highest levels of government are to blame.

Kofi Annan, United Nations secretary general, declared that the US-led war on Iraq was illegal. The invasion was not sanctioned by the UN Security Council or in accordance with the UN's founding charter.

US-led forces in Iraq have attacked population centers. There were two major offensives on the civilian town of Fallujah in 2004, as well as on al-Qaim, Tal Afar, Samarra and Najaf. These attacks have resulted in many civilian casualties and massive destruction of the urban physical infrastructure, reportedly cutting off vital necessities including water and medical supplies. These siege tactics are prohibited under Article 14 of the Second Protocol of the Geneva Conventions.

The Bush Administration, while publicly advocating diplomacy in order to stop Iran from pursuing a nuclear weapon, has increased clandestine activities inside Iran—drawing up targets, collecting information inside the country, and participating in intensified planning for a possible major air attack.
In regards to the Israeli invasion of Lebanon, the Bush regime declares that we are witnessing the widening ripples of September 11, 2001. This is the truth turned upside down. This campaign began with the invasions of Afghanistan and Iraq and now threatens war against Iran, a major target of today’s US-sponsored Israeli attack on Lebanon. Israel’s actions can’t be understood without taking this context into account.

YOUR GOVERNMENT is openly torturing people, and justifying it.

FACT SHEET:
Since January 2002, the United States has been holding men virtually incommunicado at the United States Naval Station in Guantanamo Bay, Cuba without access to any fair and adequate legal process. The U.S. Department of Defense continues to maintain strict control over the information released about its treatment of prisoners at Guantanamo.

The Bush administration claims that current prisoners of war and supposed al Qaeda prisoners are Enemy Combatants. They are using this terminology to refer to alleged terrorists captured in Afghanistan and Iraq so that no protected status or rights apply to the captured under international or domestic law. Because everyone captured in a war is supposed to be protected by the Geneva Conventions, rejecting the prisoner of war categorization and replacing it with an "Enemy Combatant" category violates international law.

POW status gives the occupying country the right to detain the captured, but not to coerce the prisoner to divulge information through force. Prisoners are to be considered POWs until there is a special hearing at which a tribunal can make a decision that they are not POWs. The Bush administration has refused to follow these procedures in Afghanistan or Iraq.

The United Nations Convention Against Torture (signed by almost every country in the world including the U.S.) states that torture cannot be used under any circumstances. At Kandahar and Bagram (Afghanistan) prisoners were beaten, shackled, repeatedly deprived of food, and kept on their knees for sixteen hours at a time (a "stress" position.) Prisoners on their way to Kandahar were dressed in orange jumpsuits, shackled at arms, legs, and waist, forced to wear blacked out goggles and ear coverings, and forcibly transported on a plane for 24 hours--unable to use the bathroom. They had to lie in their own feces and urine without knowing where they were going.

At Guantanamo Bay in Cuba, torture is:
-Psychological (such as not letting prisoners know when or if they will ever be released, putting them in isolation camps where prisoners are stripped and their heads shaved, humiliating prisoners through mocking religious beliefs such as making Muslim prisoners eat pork and look at each other's naked bodies),

-Physical (holding prisoners in dog-run cages exposed to the elements, forcing prisoners to endure temperatures of 110 degrees, sleeping on concrete floors with scorpions and rat infestations, experiencing beatings by the Immediate Reaction Force (IRF), dealing with sleep, bathroom and food deprivation, being put in stress positions such as forced kneeling chained to a ring in the floor for hours at a time).

Recently released detainees from Guantanamo have stated that they were interrogated as many as 200 times each. Especially in terms of the conditions of interrogations, this much questioning is psychologically devastating.

Prisoners in Guantanamo came from Afghanistan, but were also abducted from Indonesia, Zambia, Azerbaijan, Germany, Morocco, Gambia and Pakistan, and not always from combat situations.
Prisoner hunger strikes have persisted since February of 2002, especially in order to protest for rights to fair hearings.

In the first year and a half since Guantanamo opened, eighteen individuals made 28 suicide attempts. The suicide attempts were among 350 "self-harm" incidents reported by the military in 2003, which included 120 "hanging gestures". Also disturbing was the coordinated mass suicide attempt in August of 2003 involving ten prisoners. This form of protest followed Major General Geoffrey Miller taking of command at Guantanamo, with a mandate to acquire even more information from prisoners accused of having associations with the Taliban or Al Qaeda.

In June 2006, three detainees finally succeeded in killing themselves - a Yemeni and two Saudis who had participated in various hunger strikes committed suicide. Harry Harris, camp commander at the time, said: "They have no regard for life, either ours or their own. I believe this was not an act of desperation, but an act of asymmetrical warfare waged against us."

Similar interrogation procedures to those at Guantanamo are used at Abu Ghraib--detainees are hooded with wires with electrical currents attached to their hands, forced to simulate sexual acts, naked, with other male prisoners, led on leashes by soldiers, attacked by vicious dogs, etc.

Former head of Abu Ghraib, Janis Karpinski, has testified that a memo signed by Sec. of Defense Donald Rumsfeld was posted in the prison, with a list of "harsher interrogation techniques" to be used and a handwritten note by Rumsfeld: "make sure this happens!"

A report by Major General Antonio M. Taguba in the New Yorker states that these acts of torture "perpetuated by the soldiers of the 372nd Military Police Company, 800th MP Brigade, and also by members of the American intelligence community" include breaking chemical lights and pouring the phosphoric liquid on detainees; pouring cold water onto naked detainees; beating detainees with a broom handle and a chair; threatening male detainees with rape; allowing a military police guard to stitch the wound of a detainee who was injured after being slammed against the wall in his cell; sodomizing a detainee with a chemical light and perhaps a broom stick, and using military working dogs to frighten and intimidate detainees with threats of attack, in one instance actually to bite a detainee.

The report Article 15-6 Investigation of the 800th Military Police Brigade listed the following abuses: Punching, slapping, and kicking detainees; jumping on their naked feet; videotaping and photographing naked male and female detainees; forcibly arranging detainees in various sexually explicit positions for photographing; forcing detainees to remove their clothing and keeping them naked for several days at a time; forcing naked male detainees to wear women’s underwear; forcing groups of male detainees to masturbate themselves while being photographed and videotaped; arranging naked male detainees in a pile and then jumping on them; positioning a naked detainee on a MRE Box, with a sandbag on his head, and attaching wires to his fingers, toes, and penis to simulate electric torture; writing

"I am a Rapest" (sic) on the leg of a detainee alleged to have forcibly raped a 15-year old fellow detainee, and then photographing him naked; placing a dog chain or strap around a naked detainee’s neck and having a female Soldier pose for a picture with him; a male MP guard having sex with a female detainee; using military working dogs (without muzzles) to intimidate and frighten detainees, and in at least one case biting and severely injuring a detainee; taking souvenir photographs of dead Iraqi detainees.

The problems at Abu Ghraib were not hidden from officials--but many reports of torture were not followed up on. Abuses could have been prevented by General Karpinski had the reports been acted on as they came out (commander of the 800th Military Police Brigade, now testifies against the Bush Regime on the Bush Crimes Commission. Read her testimonies on torture at Abu Ghraib on the web at http://www.bushcommission.org/?q=node/31).

Although practices such as sleep deprivation, dietary manipulation, stress positions, and the use of dogs are now barred by the U.S., Secretary of Defense Rumsfeld told in a Senate hearing on May 12, 2004 that these techniques had been approved at the Pentagon.

Amnesty International states in 2004 that: "Full accountability, of persons at all levels of the chain of command, including officers in the armed forces, Central Intelligence Agency personnel and private contractors, with no hint of scapegoating of low-level soldiers and reservist officers, is crucial…. The problem does not begin or end at Abu Ghraib. The rule of law and promotion of security and human rights demand that daylight be shone onto all US detention policies and practices."

YOUR GOVERNMENT puts people in jail on the merest suspicion, refusing them lawyers, and either holding them indefinitely or deporting them in the dead of night.
FACT SHEET:

(1) "Inside the United States, the most radical departure from law as we know it is President Bush's claim that he can designate any American citizen an 'enemy combatant' – and thereupon detain that person in solitary confinement indefinitely, without charges, without a trial, without a right to counsel."

"We have gone back to a pre-Magna Carta medieval system, not a system of laws, but of executive fiat, where the king – or in this case the president – simply decides…I' going to throw you into some prison. You are not going to have access to a lawyer or anybody else, or even know if there are any charges against you, or if you will ever be released from this prison."

"By November 2001, the police and FBI had already arrested and detained by some estimates up to three thousand Muslim or Arab non-citizens in the United States. These people were not even suspected of terrorism; they were merely non-US citizens who had allegedly violated some immigration procedure. Many of these people effectively disappeared in US jails; a number were beaten and ultimately deported."

Regarding the basic illegality of the Guantanamo interrogation camp located in Guantanamo Bay, Cuba:

"These interrogation camps were outlawed by the Geneva Conventions in 1949, and are quite similar to the German [Nazi] World War II operations that lead to the ban."

(4) Legal experts and defense attorneys say that the government is deliberately abusing Material Witness Statutes (used in grand jury investigations) to arrest and hold thousands of people in unprecedented numbers without explanation or charges and for unknown duration:

--"'Before Sept. 11, 99 percent of the material witness orders would have never been issued,' said [defense attorney Stanley] Cohen. Now 'there isn't a federal judge in the United States, when faced with a ... sealed secret evidence assertion to an affidavit, that is going to say 'denied.'"

--"'all it takes is an accusation, and they can make your life horrible, and you spend thousands of dollars trying to prove your innocence.'"

--"'…many of the people who have been swept up in these immigration sweeps are persons who previously had been identified as political activists in their respective communities who had immigration issues.'"

--"These men were held for many months longer than necessary, in solitary confinement, often physically abused and under degrading conditions. The government fought tooth and nail against any judicial oversight of what was going on."

(10) The Bush administration's trampling of the Constitutional rights of a U.S. citizen: Yasser Hamdi.
--"The Pentagon announced that it would begin making arrangements to allow Yasser Esam Hamdi, a U.S. citizen, access to a lawyer after more than 20 months of incommunicado military detention…."

-- The Pentagon insisted that access to a lawyer was only being granted "as a matter of discretion and military policy," not to comply with any requirement of domestic or international law. Indeed, the Pentagon maintains that its decision for Hamdi should not in any way 'be treated as a precedent' to be used in any other such 'combatant' case."

-- The Pentagon's decision to grant Hamdi "access to counsel after nearly two years did not commit the administration to providing any more than that - for example, international law protections for the treatment of prisoners of war, or constitutional requirements that he be afforded notice of any charges against him and an opportunity to be heard by an independent court."

(11) U.S. citizen Jose Padilla was detained in a military prison without charges for years. The Supreme Court refused to hear Padilla's appeal in April of 2006. According to a leaked document, Bush intends to have GOP Congress enact legislation to continue to assert un-Constitutional presidential powers regarding detainment of terrorist suspects---powers that the Supreme Court has already ruled against.

--"In shifting Mr. Padilla to civilian custody, the government said that it reserved the right to re-designate him as an enemy combatant and send him back to military custody. His lawyers argued that for that reason, the Supreme Court should hear his case."

--"'Nothing the government has yet done purports to retract the assertion of executive power Padilla protests,' Justice Ginsburg said [in her dissenting opinion], adding that 'nothing prevents the executive [branch of government] from returning to the road it earlier constructed and defended.'"

--"That is, effectively, what the administration's draft of new rules for the military detention and trial of terrorism suspects would do…It seeks to have Congress write into law essentially the same procedures for military trials that the high court just said were illegal. That is, terrorism suspects still could be excluded from the courtroom, evidence could be withheld from the defense, and the Geneva Conventions — which the Supreme Court explicitly said must apply, would be circumvented."

--"More chilling is that the draft makes clear that the president wishes to impose these conditions upon any American citizen he calls an 'enemy combatant'."

YOUR GOVERNMENT moving to deny women here, and all over the world, the right to birth control and abortion.

Fact Sheet:
[pdf available]

On his very first day in office, George W. Bush reinstated a global "gag rule" on abortion. This gag rule, called the Mexico City Policy, stipulates that non-profits must scrap all services relating to abortion in order to keep any U.S. money for international family planning (coming through the relief agency USAID). He later extended this policy to all international family planning programs[1]
In the developing world, the Mexico City Policy means that the number of illegal or "back-alley" abortions increase dramatically, because without funding, many clinics must shut their doors (a clinic serving over a quarter million people in Kenya closed after USAID funding was withdrawn.) There are 20 million illegal procedures performed each year, and 70,000 deaths annually from illegal abortion procedures[2].

In November of 2003, the Bush regime signed the "partial-birth abortion" (a non-scientific term made up by the pro-life movement) ban into law, implementing the first-ever nationwide ban since abortion became legal with the Roe v. Wade decision in 1973.

The Dept. of Justice, under John Ashcroft, has requested the records of women who have received abortion services[3].

Seven states, including Illinois, Louisiana, and Kentucky have either trigger laws to ban abortion immediately if Roe v. Wade is overturned or have statements of policy that display the same intention for immediate bans.

Extreme pro-life activists have been appointed to fill important positions throughout the Bush Regime. Anti-choice governor Tommy Thompson heads up the department of Health and Human Services, abstinence-only advocate Alma Golden runs the nation's family planning program Title X, and anti-choice/Christian fundamentalist doctors opposed to contraception and all forms of abortion (even the morning after pill, which is not in fact an abortifacient) make key decisions delaying or preventing access to celebrated new contraceptives and abortifacients while they disproportionately dominate FDA advisory boards[4].

Although it is unconstitutional and currently being challenged in the Supreme Court, Congress passed, and Bush signed into law, a Federal Abortion Ban in 2003. This ban would outlaw abortions as early as 12 to 15 weeks in pregnancy.

Experts consider the fact that the Bush Regime has stacked the Supreme Court with Chief Justice John Roberts Jr. (refuses to state his views on women's right to choose) and Justice Samuel Alito Jr. (has a record of hostility toward women's rights and privacy rights) ominous, and that these appointments leave the states one more Bush judicial appointment away from prohibiting abortion[5]

The Centers for Disease Control, a (government) agency under HHS, has recently reclassified all women as "pre-pregnant" and recommends that physicians hold standards of prenatal care above other health concerns for women, celebrating pregnancy as the ultimate achievement and goal for women[6].

In March of 2006 South Dakota banned all abortions except those performed to save the life of the mother. There are no exceptions provided in this law for cases of rape or incest. The law was passed "in hopes of drawing a legal challenge that will cause the US Supreme Court to reverse its 1973 decision legalizing abortion."[7]

The Bush regime has passed the Unborn Victims of Violence Act, which gives a fertilized egg legal status distinct from woman. This law is a clear threat to the foundations of Roe v. Wade.[8]

YOUR GOVERNMENT enforces a culture of greed, bigotry, intolerance and ignorance.
FACT SHEET:

10-term Republican incumbent Rep. Richard H. Baker from Baton Rouge was overheard telling lobbyists: "We finally cleaned up public housing in New Orleans. We couldn't do it, but God did." after Katrina hit New Orleans.
Tapes of White House video-conferences about Hurricane Katrina with emergency officials show that President Bush was fully aware of the threat posed to New Orleans before Hurricane Katrina. He claimed to be "fully prepared" for the crisis. The tapes make it clear that he personally received serious warnings of what could happen if the levees protecting New Orleans gave way. However-four days after the storm hit he told reporters: "I don't think anybody anticipated the breach of the levees." Then he allowed the National Guard to descend on the city of New Orleans with shoot-to-kill orders.

These orders mainly applied to the thousands of poor Black people who were labeled "looters" to the rest of world while merely attempting to survive the disaster by obtaining food, water and other supplies.

Although the majority of New Orleans residents were Black before Katrina hit, mostly only well-off white people have been allowed or able to return to the city. The federal office of Housing and Urban Development, or HUD, plans to raze half the low-income housing units in the city and replace them with more "mixed-income" housing. Only 20% of the 5,000 mostly Black families that lived in public housing in N.O. have been able to return since the Hurricane.

U.S. based firms Halliburton and Bechtel Halliburton Corp., previously headed by Vice President Dick Cheney and former Secretary of State George Shultz and ex-Defense Secretary Caspar Weinberger, respectively, have won billions of dollars in regular and no-bid contracts for work in Iraq from the U.S. government. Haliburton is the biggest single government contractor in Iraq This sort of unimpeded war profiteering is indicative of the deep rooted greed of the Bush Regime.

The Washington Post reports that the practice of turning to private contractors for a broad range of military logistics operations dates to a study commissioned by then-Defense Secretary Dick Cheney after the 1991 Persian Gulf War. The Pentagon chose Brown and Root to conduct the study and then hired the company to implement its own plan. Cheney became chief executive of Halliburton, Brown and Root's parent company, in 1995 and remained there until 2000, when he left to run for the vice presidency.

The legislature and the Bush regime as a whole are currently attempting to ban same-sex marriage on a nationwide level through the Federal Marriage Amendment, a constitutional amendment that would also ban civil unions and marriage-related benefits such as the ability to file jointly on taxes. This attempt, which would increasingly stigmatize gay couples in society, is a blatant manifestation of the disregard and outright hatred for the LGBTQ community which prevails under the Bush Regime.
The Bush regime has also passed the Defense of Marriage Act, or DOMA, which defines marriage as a legal union of one man and one woman. This way, federal law can never be interpreted otherwise. Under the DOMA, the Federal government refuses to recognize same-sex marriages or civil unions, even if state law, like in Massachusetts, recognizes those unions. (so the military can force prisoners to masturbate and sodomize one another, yet there will be no same same sex unions?)

MORE THAN NEWS: THE DAY MIKE RUPPERT LEFT AMERICA

MORE THAN NEWS: THE DAY MIKE RUPPERT LEFT AMERICA

It is becoming a growing trend, as I speak with more and more people that a time to depart america is becoming more imminent. Many, many people I speak to WANT TO LEAVE.
I know for me, its integral to every core aspect of my being to leave a country that has taken a very serious downward path, leaving very little for the average person in its wake.

September 18th 2006, 2:23 PM [PST] - It was Monday, July 17th, late in the morning when the phone rang in my office. I answered it as I always do with “More Than News”. The voice on the other end was Mike Ruppert. He said he had been driving since three in the morning and that he needed me to do something for him. I of course said “What is it?” You never know what it is when Mike asks you for something. It’s not like Mike asks for simple, normal things like “can you get me a newspaper?” This has never been a problem, just an observation over the years. He said he needed to get to Caracas, Venezuela and that he needed to get there immediately. Oh, OK, no problem. I asked why? He said “because it’s time”. I knew exactly what that meant. I had visited the offices in Ashland, Oregon a few weeks earlier and knew Mike was spending his last days here in this country.

After I got off the phone, I called my wonderful travel agent who had done many trips for Mike, FTW and myself in the past, AND has read cover to cover, “Crossing The Rubicon”, which I know changed his life a bit. This was the same travel agent who took care of us on trips to Toronto, Seattle, Montana, New York and Mike on trips to Germany, England, and last minute jaunts to Washington D.C. among others. Now I was asking him to pull a rabbit out of a hat for us. You see, Mike needed to leave on this journey from another country. No red flags. No credit cards. No personal cell phone calls. It was Tijuana, not Los Angeles International that Mike needed to leave from.

So, after an evening alone at the local Marriot Hotel, Mike came to my home the next morning, walked right in, was greeted by a barking dog, Molly, and by my two offspring (I can’t call someone 15 and someone 19 children any longer), hugged them both, and we were off to rent a car, to begin the journey down to Tijuana, Mexico, where Mike’s new life was going to begin.

We spoke about a lot of things on the drive south. We spoke about why he was leaving his country he could no longer believe in. We spoke about his company, From The Wilderness and how important it was to keep it alive. We spoke about what we could say and couldn’t say about his whereabouts. We spoke about all the events that had plagued FTW over the past several years. We spoke about some of the landmark, ground-breaking stories FTW had broken over the past few years. He spoke fondly of his writers, mentioning Mike Kane, Stan Goff, Carolyn Baker, and of his dear friends, Catherine Austin Fitts and Rep. Cynthia McKinney. He went through several moments of just spacing out—looking at the scenery on Interstate 5, watching everything as it passed us by and occasionally talking about how he had to leave this country. I could tell Mike was tired, the kind of tired that makes it hard to think. It seemed he had already thought about this. No need to continue. Mike and I have always had an interesting relationship. We would argue a lot, mainly because I still believed in the tooth fairy, and of course Mike didn’t, and he enjoyed proving to me why I shouldn’t. We were opposites in so many areas but the same in many others, especially music, Mike’s real passion. It was always difficult for me to believe as he did, that people could be so cruel and underhanded—that it wasn’t always as it seemed.

We stopped in San Juan Capistrano to get a bite to eat. Walked around the town and stepped into a local 50’s diner with approximately 10 children under the age of 6 for every adult, including one who had a scream that seemed it would have shattered glass. Mike thoroughly enjoyed his Kobe beef burger and milkshake. We filled the car with gas and hit the road. We were not sure about driving the rental car over the border, and we were not comfortable about having Mike take a shuttle to the Tijuana airport either. I wanted to see Mike off at the airport for myself so we decided to head straight to the airport. A sign said ‘aeropuerto’ 6 Km. It took an hour to find it, even though Mike used his Spanish speaking abilities and sign reading prowess to the max. It was a victorious moment when we finally stumbled on to the sign “Tijuana International Airport”.

I pulled into a small lot at the corner of the front of the terminal. I stopped the car and opened up the trunk. I saw Mike grab his very heavy suitcase and his carry-on with his laptop. For one quick moment I thought of things that should have taken twenty minutes to think of. Where’s all his other stuff, I thought to myself. Mike never really lived, at least since I’ve known him, with some of the luxuries and niceties a lot of us live with. But now, he was living in a home in Ashland he was quite proud of. Nice view, nice furnishings, and all the appliances and items necessary to enjoy a home life. And he was leaving it all behind. What was going to happen to all his possessions? Not enough time to think about this and ask him. Although we were early, it was easy to see Mike wanted to just get this first leg of his journey over with. It was on to Mexico City before leaving for Caracas.

We said goodbye, not a big scene, and I watched him lug his stuff until he disappeared into the terminal. Of course, not before he lit up a cigarette. I got back into the car, and made it back to the border, only to see there was at least a two-hour delay and wait to cross. Remembering what Mike had told me earlier in the day, I turned my cell phone off, and for the first time in a long time, I had some time to think. A lot of time. Thanks Mike.

U.S. bar panel raps Bush on signing statements

Its about time.

WASHINGTON: The powerful American Bar Association charged president George Bush with flouting the constitution and undermining the rule of the law by assuming power to disregard selected provisions of bills he signs.

An 11-member bipartisan panel of the bar association said in a report that Bush had used the provision of "signing statements" far more than his predecessors, raising constitutional objections to over 800 provisions in more than 100 laws as they infringed on his prerogatives.

The panel said these uses of power by the president amounted to "veto" and deprived the Congress of the opportunity to override the veto.

A signing statement is a statement attached to a legislative bill when the president signs it to make it a law. Usually, such statements pertain to instructions to law enforcing agencies on how to use the law.

The panel cited laws relating to ban on torture and other national security laws, where Bush had, through the signing statements, reserved the right to disregard them.

The report described the use of signing statements as "contrary to the rule of law and our constitutional system of separation of powers." It said the president has the right to veto a bill if he feels the bill is unconstitutional, but "signing statements should not be a substitute for a presidential veto."

The report comes as a shot in the arm for a campaign being initiated by scholars and members of the Congress who seek to curb the use of signing statements.

Judiciary committee chairman and Republican Arlen Specter said on the Senate floor that he will have a bill ready by the end of the week allowing the Congress to sue the president in a federal court on the issue of using signing statements. Specter told the Senate, "We will submit legislation to the United States Senate which will ... authorize the Congress to undertake judicial review of those signing statements with the view to having the president's acts declared unconstitutional."

Specter is particularly annoyed by two signing statements challenging the provisions of the USA Patriot Act renewal, which he wrote, and legislation that bans torture of detainees.

American Bar Association president Michael Greco said the non-veto hamstrings the Congress because the Congress cannot respond to a signing statement. The practice, he said "is harming the separation of powers."

The panel said Bush has challenged about 750 statutes passed by the Congress.

The White House defended the use of signing statements, saying these are not intended to allow the administration to ignore the law. A spokesperson said a great many of those signing statements may have little statements about questions about constitutionality. "It never says, 'We're not going to enact the law.'"

A Republican Senator and a former judge, John Cornyn, said signing statements carry no legal weight because federal courts are unlikely to consider them when deciding cases that challenge the same laws. They amount of mere expressions of presidential opinion.

The panel said its recommendations should not be construed as an attack on the president. It said several previous presidents had asserted the right to disregard provisions of a law to which they objected. But, Bush had expressed his objections more forcefully, more often and more systematically, "as a strategic weapon" to influence federal agencies and judges, it felt.

The panel also found Bush’s signing statements often used the same formulaic language, with no citation of authority or detailed explanation. It urged the Congress to pass a law requiring the president to elaborately state the reasons and legal basis for any signing statement where he intended to disregard or decline to enforce a statute. The panel also recommended legislation enforcing judicial review of signing statements.
